These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Tour Expert AI ("Company", "we", "us", or "our"), governing your access to and use of our website at tourexpertai.com and all related platforms, tools, and services (collectively, the "Services").
By creating an account, accessing, or using our Services in any manner, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not access or use our Services.
Tour Expert AI provides an AI-powered platform designed for tour agents and travel agencies. Our Services include:
- An intelligent chatbot that answers customer queries based on your uploaded tour catalogues
- Automated tour package recommendation engine
- WhatsApp marketing campaign management and bulk messaging tools
- An agent dashboard with analytics and performance tracking
- Website chatbot embed code for integration into your existing site
We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.
Eligibility
You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use our Services. Our Services are intended for business use by tour agents and travel industry professionals.
Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Provide accurate, current, and complete registration information
- Keep your password secure and not share it with any third party
- Notify us immediately at hello@tourexpertai.com if you suspect any unauthorised access
- Ensure only authorised personnel access your account
Tour Expert AI cannot and will not be liable for any loss or damage arising from your failure to maintain adequate account security.
Free Trial
We offer a 14-day free trial with access to all features. No credit card is required to start a trial. At the end of the trial period, you may choose a paid subscription plan to continue using the Services.
Paid Plans
Subscription fees are billed in advance on a monthly or annual basis depending on your chosen plan. All prices are in Malaysian Ringgit (MYR) unless stated otherwise.

Cancellation & Refunds
You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period — you will retain access to the Services until that date.

We do not offer refunds for partial billing periods or unused features. Annual plan refunds may be considered on a case-by-case basis if requested within 7 days of renewal. Please contact us to discuss.
Late Payments
If payment fails, we will notify you and attempt to charge again within 3 days. If payment remains unsuccessful after 7 days, your account may be suspended until payment is resolved. Data is retained for 30 days after suspension before permanent deletion.
You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not use the Services to:
Prohibited Activities
- Violate any applicable Malaysian or international laws or regulations
- Send unsolicited bulk messages (spam) or messages to contacts who have not consented to receive them
- Upload false, misleading, or fraudulent tour package information
- Impersonate any person or entity or misrepresent your affiliation
- Upload content containing viruses, malware, or any harmful code
- Attempt to reverse-engineer, decompile, or extract the source code of our platform
- Resell, sublicense, or commercially redistribute access to the Services without our written consent
- Use automated scripts or bots to scrape, crawl, or excessively load our platform
- Harass, abuse, or harm any person through the use of our Services
WhatsApp Campaign Compliance
When using our WhatsApp campaign tools, you are solely responsible for ensuring compliance with WhatsApp's Business Policy, Malaysia's Communications and Multimedia Act 1998, and the Personal Data Protection Act 2010 (PDPA). You must only send messages to contacts who have provided explicit consent to be contacted by your business.

We reserve the right to suspend or terminate accounts that we reasonably believe are in violation of applicable messaging laws or WhatsApp's usage policies.
Ownership
You retain full ownership of all content you upload to Tour Expert AI, including your tour catalogues, pricing documents, customer databases, and any other materials ("Your Content"). We do not claim any ownership rights over Your Content.
Licence to Us
By uploading Your Content, you grant Tour Expert AI a limited, non-exclusive, royalty-free licence to store, process, and use Your Content solely for the purpose of providing the Services to you. This licence ends when you delete the content or close your account.
Your Responsibilities
You are solely responsible for Your Content and warrant that:
- You have all necessary rights to upload and use the content
- Your Content does not infringe any third-party intellectual property rights
- Any customer data you upload has been collected with proper consent under PDPA
- Your Content does not contain any unlawful, defamatory, or harmful material
Data Isolation
Your uploaded tour catalogues and customer databases are stored in isolation and are never shared with, or accessible by, other Tour Expert AI users. We do not use Your Content to train shared AI models.
All rights, title, and interest in and to the Tour Expert AI platform — including its software, design, interfaces, algorithms, trademarks, logos, and documentation — are and remain the exclusive property of Tour Expert AI and its licensors.
Nothing in these Terms grants you any right to use our trademarks, brand names, logos, or domain names without our prior written consent.
You may not copy, modify, distribute, sell, or create derivative works of our platform or any part of the Services without express written permission from us.
The Services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that:
- The Services will be uninterrupted, error-free, or completely secure
- AI-generated responses will always be accurate, complete, or appropriate for your use case
- The Services will meet your specific business requirements
- Any errors or defects will be corrected within a specific timeframe

Tour Expert AI is an AI-assisted tool. You remain responsible for reviewing AI-generated content before sharing it with customers, and for all business decisions made based on information from the platform.
To the fullest extent permitted by applicable law, Tour Expert AI and its directors, employees, partners, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, revenue, data, or business opportunities
- Damage to goodwill or reputation
- Cost of substitute services
- Any damages resulting from unauthorised access to your account or data
In no event shall our total aggregate liability to you exceed the total amount paid by you to Tour Expert AI in the twelve (12) months immediately preceding the event giving rise to the claim.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain types of damages, so some of the above limitations may not apply to you.
By You
You may terminate your account at any time by cancelling your subscription through the dashboard or by contacting us. Upon termination, your access to the Services will end at the close of the current billing period.
By Us
We reserve the right to suspend or permanently terminate your account, with or without notice, if we determine that you have:
- Violated any provision of these Terms
- Engaged in fraudulent, abusive, or illegal activity
- Failed to pay subscription fees after the grace period
- Used the Services in a way that causes harm to others or to our platform
Effect of Termination
Upon termination, your right to access the Services ceases immediately. We will retain your data for up to 30 days after termination, during which you may request an export. After this period, your data will be permanently deleted from our systems.
These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law principles.
Any dispute, controversy, or claim arising out of or in connection with these Terms, or the breach, termination, or validity thereof, shall first be attempted to be resolved through good-faith negotiation between the parties.
If a dispute cannot be resolved through negotiation within 30 days, it shall be submitted to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia.
We reserve the right to update or modify these Terms at any time. When we make material changes, we will:
- Update the "Last updated" date at the top of this page
- Notify registered users via email at least 14 days before changes take effect
- Display a prominent notice on our platform dashboard
Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Services and cancel your account before the changes take effect.
